Hydrogeology, glaciology and independent water auditing for the San Juan cordillera
The Glacier Law reform, enacted on 24 April 2026, turned a general prohibition into a technical question: protection now depends on the ice body having «función hídrica relevante», and the inventory is defined by the provinces. Eleven days later came the class action, and by 16 July there were two injunctions requested and none resolved — the second to keep glacier GE110 from being removed from the inventory, which sits inside Vicuña's 259-hectare pit. That means the study no longer has to convince an office: it has to hold up in a tribunal. And beneath the litigation runs a clock that does not stop: every operator resubmits its environmental report every two years.
What the market is made of
The split here has an unusual shape: what is captive is the signature, not the work. The integrated report is signed by an international consultancy and the day-to-day monitoring is done by the mine's own team. But everything feeding those two —the field data, the sensor network, the laboratory work and the expert evidence— is open, and the speciality the reform made compulsory barely has local supply.
The rule that moves it
Here the rule does not accompany the demand: it creates it. And a second one decides who can invoice it: Each one opens its own page, with the rule, since when it applies and its primary source.

The environmental impact report for a multi-billion-dollar project is signed by a consultancy with professional indemnity cover and an international track record. That piece is not contested from a provincial small firm. What is contested is everything that feeds it: the field data, the monitoring network and the laboratory work.
In operation, much of the monitoring is done by the company itself. It is the hardest incumbent to displace, which is why the way in is not replacing it: it is the layer the operator cannot sign off on its own, which is exactly the one that gains value when the data get argued about outside.
The reform left it in a registry role and handed the provinces the task of defining what gets protected. It stopped being the decider and it is not a commercial competitor: it is the register against which a party's study is later checked.
They do not compete for the private contract: they are the technical counterparty whose objections have to be answered. INA-CRAS objected to the insufficiency of Josemaría's hydrogeological data prob, and that sets the standard for what has to be produced.
The gap has three layers and all three are named by the province's own research:
Glaciology and the periglacial environment, the speciality the reform made compulsory and which barely exists in the country. The national body was left in a registry role and private consultancies in the field can be counted on one hand. It is the highest-margin layer and the hardest to enter, because it is bought on track record.
Party-appointed expert evidence, which before May 2026 was not a market. With two injunctions requested and none resolved, the study stopped being paperwork and became evidence. It is contracted by the law firm, billed differently, and requires a signatory who can survive a challenge.
Independent water auditing: the third party that certifies the company's data. It has no declared supply in the province. And its value is not technical but reputational: in a territory still carrying the 2015-2017 Veladero spills and an active assembly in Jáchal, a figure signed by the operator itself does not close the argument.
The telemetry monitoring network, which is the cheapest door. The physical scale is already proven: El Pachón's 2025-26 campaign drilled 21,246 meters across 53 holes, and that is one campaign of one project. Installing and running piezometers with continuous reporting does not require an expert's signature: it requires being nearby and not failing.

When you get paid, and what blocks it

It is one of the few niches where the service and the social license point the same way. San Juan still carries the 2015-2017 cyanide solution spills at Veladero and an active assembly in Jáchal; a third party that measures and publishes with method is the only thing that can close that argument with something other than a statement from an interested party. On water, the proportion is worth having to hand because it orders the debate: mining consumes on the order of 1 to 3 % of provincial water against 83 to 90 % for agriculture prob. And there is a sharing model that already exists and is replicable: the Los Azules concession fee, around USD 5 M prob, is earmarked for water works in Calingasta — the same department whose irrigators publicly asked for the concession to be approved.

Concentration Concentration is split in two, and the bottom half is the empty one. A large project's environmental impact report is signed by an international consultancy and that does not move. But local supply in the speciality the reform made compulsory —glaciology and periglacial environment— is scarce by the province's own research: IANIGLA was left in a registry role and specialized private consultancies can be counted on one hand. And there is a third layer with no declared supply at all: independent water auditing, meaning the third party that certifies the company's data before a neighbor, a judge or a regulator. In a province still carrying the 2015-2017 cyanide solution spills at Veladero and an active assembly in Jáchal, that credibility has a price.
Who really pays?
Three payers, and the third only appeared in May 2026:
It is the predictable door and the one that does not depend on the litigation. Josemaría had its update approved in March 2026 and Vicuña its first and second: the two-year clock runs for every site with a live report, and each one's due date is known.
Here the pressure comes from the regulator: the Policía Minera inspects on the ground and requires traceability. And the standard was set by a specific objection — INA-CRAS challenged the insufficiency of Josemaría's hydrogeological data, plus salinity and heavy metals.
It is the new door and the highest-margin one. The class action against the reform is from 5 May 2026 and the injunction over glacier GE110 from 23 June; by 16 July neither had been resolved. While that proceeds, what is bought is not a report: it is an opinion that survives a challenge.
What we watch · when to enter
This is not «what breaks it»: it is the dashboard for getting in at the right moment. Here there is one indicator that can split the niche in two depending on how it lands.
The first, from 5 May 2026, asks for the reform's effects to be suspended. The second, from 23 June, asks that San Juan and IANIGLA refrain from removing glacier GE110 from the National Inventory while the case proceeds — and that glacier sits inside Vicuña's 259-hectare pit. All three sources from the claimant parties were opened and none identifies a court or case name, so tracking is done through the claimant organizations' publications and the Boletín Oficial. How to read each outcome: if the injunctions are rejected, the glaciology layer consolidates as predictable administrative demand; if they succeed, that layer transforms —it does not disappear— into judicial expert-evidence demand, which pays more and lasts as long as the case does. In both scenarios the biennial update and monitoring network blocks keep running, because they do not depend on this rule.
There is a class action filed on 5 May 2026 with two injunctions requested and none resolved as of 16 July 2026 prob. If the reform falls, protection reverts to being general and the technical question of «función hídrica relevante» stops making commercial sense. ⚠️ Beware the easy reading: the biennial update block and the monitoring network block do not depend on the reform and keep running regardless. What falls is the glaciology and expert evidence layer, which is the highest-margin one.
The DEAM declares 79 environmental assessments «in the reported period» and no source says whether that period is one year, two or five. The block resting on that figure is the largest in the calculation. If the period were five years, that block divides by five and the total TAM falls below the published floor. It is the first number to close, and it closes in the annual report of the Secretaría de Gestión Ambiental y Control Minero.
The fee band used is the one our own Salta entry publishes, and that entry states its fee is a pure assumption. There is no open fee schedule: the two San Juan professional councils we tried —cpiasj.org.ar and cpia.com.ar— could not be opened. If the real fee were half of it, so would the TAM be.
Josemaría's declared structural plan is to bring in desalinated Pacific water by aqueduct from year 7 prob. If that works advances, pressure on the local aquifer drops and with it the requirement for intensive monitoring. It is a slow risk —year 7 is far off— but it changes the niche's shape, not today's size.
There are four or five operators. A single badly finished contract closes the whole market, and the state's technical counterparty is always the same one. In a business that sells credibility, reputation is not an intangible: it is the asset.
Ley 2827-M requires 24 months of seniority to qualify as local in the department of influence and 12 in the rest of the province. A consultancy setting up in 2026 does not count as a San Juan supplier towards local purchase targets until 2028, even though the demand is running now.

How we validate this figure
This figure is counted in deliverables per year, not as a percentage of anything. The universe comes from three separate clocks: the 79 environmental assessments the provincial assessment directorate declares, the compulsory biennial update of each impact declaration, and the four cordilleran projects the reform obliges to prove hydrological function. And there are two limits we state rather than hide. The first is a denominator: the figure of 79 is declared «in the reported period» and no source says what that period is, so we assume one to two years — that assumption alone accounts for close to half the width of the band. The second is price: we could not get a published fee. We went looking for it at the professional council, which is where it turned up in Salta, and the two sites we tried do not open. That is not a proven absence, it is a gap, and we leave it written with both names so it can be picked up. In the meantime we use the same fee band we already publish in the Salta entry, which also declares itself an own assumption.
