Plan Gas.Ar: the producer that signs up stops reporting its investments every quarter

The Secretaría de Energía changed two things in the Plan Gas.Ar (Decreto 892/20) for producers that sign up, and only for them. The first one is about getting paid: a producer that had signed supply contracts with ENERGÍA ARGENTINA S.A. for the priority demand of the distribution companies must accept that those contracts be assigned to the distributors; once the assignment is completed it collects monthly, and directly, the share of the injection price paid by the State. The second one is about oversight: the signatory «quedará relevado del deber de informar en forma trimestral y con apertura mensual, el avance del Plan de Inversiones» — it is relieved of the duty to report, quarterly and broken down by month, the progress of the Investment Plan under Point 11 of the Annex to Decreto 892/20. ⚠️ With two limits the norm itself writes down: the obligation to execute the committed investments stays intact and the Secretaría keeps the power to ask for progress whenever it wants to verify it; and the relief does not reach the commitments of Ronda 5.2 (Resolución 770/2022 and its five awards). Two calculation adjustments come with it: the production curve is no longer divided by 0.7 to determine the injection commitment, and the provisional payment under Point 4.20 rises to 90% of the declared compensation. Resolución 606/2025 has been in force since it was published, on 29-Dec-2025, but its conditions apply to each producer only when it signs up and — as Resolución 36/2026 clarified — once the assignment of its contracts with ENERGÍA ARGENTINA S.A. is completed. The Productores Firmantes of the Plan Gas.Ar — the natural gas producers with volumes awarded in the rounds of Decreto 892/20 — and the piped gas distribution companies, which become the direct counterparty of the contracts they previously held with ENERGÍA ARGENTINA S.A.
